Corporate & Commercial – The China-Australia Free Trade Agreement and the opportunities for South Australia

During the recent visit by the President of the People's Republic of China, Xi Jinping, to Australia a declaration of intent for the China Australia Free Trade Agreement (FTA) was signed in Canberra by the leaders of both countries, with the FTA planned to come into effect in 2015.

The agreement is a major win for Australia. 93 per cent of Australian exports to China will be tariff-free within four years and taxes on Chinese imports including clothing and electrical goods will be removed. The Australian Government expects that the FTA will boost the Australian economy by $18 billion over 10 years in a win-win for both countries, it is also estimated that consumers will enjoy a billion-dollar-a-year price cut on Chinese imports.

Workers’ Compensation — New ‘return to work’ framework becomes law

We previously informed our readership of the significant changes to the South Australian workers’ compensation framework, which at that time was under consideration by State Parliament. Those changes have now been assented into law, with very little substantive amendment from their original introduction, as the Return to Work Act 2014 (SA) and the South Australian Employment Tribunal Act 2014 (SA).

Succession Planning – Summer dreaming

This time last year, I discussed the need to put some time aside to consider whether your affairs are in order over the summer as you look back over 2013.

If you are anything like the majority of people, life probably got in the way of thinking about what would happen if you, or anyone in your family or business were to suffer a serious injury or death. Fortunately, if you are reading this, you have a chance to consider your circumstances again this year.

Employment - Performance management vs bullying

As practitioners, we have increasingly noticed a spike in the number of workplace bullying complaints which stem from performance management processes.

Employees often believe they are being unfairly targeted. A recent decision of the Fair Work Commission shows that, where an employer can establish objectively legitimate performance concerns, and takes reasonable actions in response, it is not workplace bullying.
